Subdivision and Development Appeal Board (SDAB)

The Subdivision and Development Appeal Board (SDAB) is a quasi-judicial statutory body intended to perform an independent adjudicative function that hears and makes decisions on appeals related to Development, Subdivisions and Stop Orders.

Council appoints five (5) residents to the Subdivision and Development Appeal Board (SDAB). The SDAB:

  • Hears and makes decisions on appeals related to stop orders, developments and subdivisions.
  • Functions in accordance with the Municipal Government Act and the Lacombe County SDAB Bylaw.
  • Hears complaints and functions like a legal court.
  • Examines evidence and applies legal rules to their findings.
  • Makes decisions after conducting a fair hearing that complies with legislation, administrative law and the principles of natural justice.
  • Makes final decisions that cannot be overturned unless an error in some aspect of law or jurisdiction.

A decision related to a development permit application can be appealed by people who may be affected by a decision of the Development Authority. A decision related to a subdivision application can be appealed by the applicant, government department or a school board. The subject of a Stop Order may also file an appeal to the SDAB.

The Lacombe County Assessment Review Board (ARB) is comprised of the SDAB members and hears and makes decisions on property assessment complaints.

SDAB and ARB members are required to successfully complete board training to maintain their eligibility as qualified board members.The SDAB/ARB will also hear appeals brought forward under the Weed Control Act as per Section 19 of the Act and Agricultural Pest Act as per Section 14(5) of the Act.
